1. About us

The Joint on Market ("we", "us", "our") is a veteran-owned, licensed recreational and medical cannabis retailer located at 3270 Market St NE, Salem, Oregon. We operate under the rules of the Oregon Liquor and Cannabis Commission (OLCC) and, for medical sales, the Oregon Health Authority (OHA).

If anything in these terms conflicts with Oregon law or OLCC rules, the law will apply.

2. Eligibility

To use our website, place an order or buy from our store, you must be:

• 21 years of age or older; or
• 18 years of age or older and a registered patient in the Oregon Medical Marijuana Program (OMMP) with a valid OMMP card.

You must show a valid, unexpired government-issued photo ID (and your OMMP card, if applicable) at every purchase, pickup and delivery. We will refuse any sale or delivery if we cannot verify your age and identity, if you appear to be intoxicated, or if we reasonably believe you are buying for someone who is not allowed to purchase cannabis.

3. Accounts

You may need an account to order online. You agree to give accurate, current information and to keep your login details private. You're responsible for all activity on your account. Accounts are personal and may not be shared or transferred. We may suspend or close accounts that break these terms or the law.

4. Products and product information

We work hard to make sure product descriptions, images, cannabinoid content and prices on our website are accurate. However:

• Images are for illustration only, and actual products may vary in appearance.
• THC, CBD and terpene figures come from licensed lab testing and producer information, and may vary slightly between batches.
• Product availability changes often, and items shown online may sell out before your order is confirmed.
• Descriptions of effects are general and are not promises. Cannabis affects everyone differently.

If we find an error, we may correct it, update your order or cancel it, and we'll let you know.

5. Pricing and payment

Prices are shown in U.S. dollars. Oregon's state retail marijuana tax and any applicable local tax are added to recreational cannabis purchases as required by law. Registered OMMP patients may be exempt from the retail marijuana tax on eligible purchases.

The payment methods available are shown at checkout online and at the counter in store. Prices and promotions may change at any time without notice, but changes won't affect orders that have already been confirmed and paid for.

6. Orders and purchase limits

Placing an order online is an offer to buy. Your order is accepted only when we confirm it. We may decline or cancel any order, for example if a product is unavailable, there is a pricing error, we can't verify your eligibility, or the order would exceed Oregon's legal purchase limits.

Oregon sets daily purchase limits for each product type. Our systems apply these limits automatically, and we may adjust or refuse orders that go over them. Cannabis purchased from us is for personal use only and may not be resold.

Pickup orders are held for a limited time. If you don't collect your order, we may cancel it and return the items to stock.

7. Pickup and local delivery

Cannabis orders can be collected in store, through curbside pickup, or delivered within our local Oregon delivery area where available. For delivery:

• Deliveries are made only to residential addresses in our delivery area, not to public places, businesses, hotels, schools, or federal or public land.
• The person who placed the order must be present and show valid ID. We cannot leave orders unattended or hand them to anyone else.
• Delivery times are estimates and may vary due to demand, traffic or weather.
• If delivery can't be completed, for example because no one eligible is home, the order will be returned to the store.

8. Shipping (hemp-derived CBD only)

We never ship marijuana or THC cannabis products. Federal law prohibits transporting cannabis across state lines, and all cannabis bought from us must stay in Oregon.

Hemp-derived CBD products that meet federal hemp rules may be shipped to addresses in U.S. states where they are permitted. You are responsible for making sure the products you order are legal where you live. We do not ship outside the United States. Risk of loss passes to you once the carrier delivers your order.

9. Returns and warranty

Because cannabis is a regulated product, we cannot accept returns for change of mind. Defective, damaged or incorrect products are covered by our Warranty & Returns policy, which forms part of these terms.

10. Promotions, deals and discounts

Daily promotions, happy hour specials, veteran discounts and other offers are subject to availability and may change or end at any time. Unless stated otherwise, discounts can't be combined and have no cash value. Veteran discounts require valid proof of service. All promotions comply with Oregon cannabis advertising and sales rules.

11. Responsible and legal use

By buying from us, you agree to use cannabis responsibly and legally, including that you will:

• Not share, sell or give cannabis to anyone under 21.
• Not drive or operate machinery under the influence of cannabis.
• Not use cannabis in public places or in vehicles.
• Not take cannabis out of Oregon or onto federal land.
• Store products securely and out of reach of children and pets.

Cannabis can impair concentration, coordination and judgement. Do not use it if you are pregnant or breastfeeding. Information on our website is for education only and is not medical advice. Speak to a healthcare provider before using cannabis, especially if you have a medical condition or take medication.

12. Use of our website

You agree not to misuse our website. That includes not attempting to gain unauthorised access, interfere with its operation, upload harmful code, scrape content, create false accounts, or use the site for any unlawful purpose. We may restrict access to anyone who breaks these rules.

Our website may link to third-party sites. We're not responsible for their content or practices.

13. Intellectual property

All content on this website, including text, graphics, logos, design and layout, belongs to The Joint on Market or its licensors and is protected by law. Brand names and product images belong to their respective owners. You may not copy, reproduce or use our content for commercial purposes without written permission.

14. Disclaimers

Our website and services are provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties beyond those set out in our Warranty & Returns policy, and we don't guarantee that the website will always be available, error-free or secure. We make no claims that any product will diagnose, treat, cure or prevent any disease.

15. Limitation of liability

To the fullest extent permitted by law, The Joint on Market will not be liable for any indirect, incidental, special or consequential damages arising from your use of our website or products, including the effects of cannabis use. Our total liability for any claim relating to a purchase will not exceed the amount you paid for the product involved. Nothing in these terms limits any rights you have that cannot be limited under Oregon law.

16. Indemnity

You agree to indemnify and hold harmless The Joint on Market, its owners, employees and partners from any claims, losses or expenses arising from your breach of these terms, your misuse of our products or website, or your violation of any law.

17. Governing law

These terms are governed by the laws of the State of Oregon. Any dispute will be handled in the state or federal courts located in Marion County, Oregon, unless the law requires otherwise. If any part of these terms is found to be unenforceable, the rest will remain in effect.

18. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top of this page shows when they were last changed. Continuing to use our website or buy from us after changes are posted means you accept the updated terms.
